General Conditions of Sale 1. Presentation of the company The company GOLDBEAUTE, a limited liability company, registered in the Soissons Trade and Companies Register under number 798 693 800, whose registered office is located at 611 rue des moines, 02200 Villeneuve-Saint-Germain (hereinafter referred to as “ GOLDBEAUTE "). 2. Scope of application These General Conditions of Sale (hereinafter the "GCS") apply to all sales concluded by GOLDBEAUTE on the site https://www.goldbeaute.fr/en/ (hereinafter the “Site”). The fact, for any customer of the Site (hereinafter the “Customer”), of ordering products sold by GOLDBEAUTE (hereinafter the “Products”) on the Site implies its full and unreserved acceptance of these General Terms and Conditions, which prevail over any other specific conditions of the Customer, in particular its general conditions of purchase, unless prior written exemption from GOLDBEAUTE. . GOLDBEAUTE reserves the right to modify the General Terms and Conditions at any time, the latter being applicable as soon as they are put online, excluding current transactions. 3. Professional status The site is exclusively reserved for professionals. As such, the Customer must provide the company name and their first and last name when registering on the Site. The Customer undertakes to make purchases on the Site (hereinafter the “Purchases”) solely for the purposes of their professional activity. 4. Registration on the Site Account creation: Any Purchase made on the Site is subject to the creation of an account by the Customer. The latter must imperatively provide the contact details allowing the processing of their orders (invoicing, delivery) by GOLDBEAUTE, including: The company name and, where applicable, the SIRET number, His first and last name, His postal address and his email address. Updating information: The Customer undertakes to update this information as soon as a change occurs in his contact details. Identifiers: The Customer must choose a username and a password (hereinafter the “Identifiers”) which he will be required to reuse for his future Purchases on the Site. The Customer undertakes to keep his Identifiers secret and not to disclose them to any third party. The Customer is solely responsible for accessing the Site using his Identifiers, unless he provides proof of fraudulent use for which he is not responsible. 5. Conclusion of the sales contract Presentation of Products: The Products are presented on the Site with a description allowing the Customer to know their essential characteristics and their price. Availability of Products: The availability of a Product is indicated on its description sheet. The Product may be “in stock” or “being restocked”. GOLDBEAUTE makes its best efforts to ensure the accuracy of the availability of a Product. However, it cannot be held liable if such information proves to be inaccurate. Order process: The Customer selects the Product(s) he/she wishes to purchase. He/she confirms his/her choice of Product(s) by validating his/her basket and acknowledges and accepts these General Terms and Conditions by clicking to validate. The Customer then proceeds to pay for his/her order under the conditions set out in Article 4 of the General Terms and Conditions. Once the payment has been validated, the Customer receives an email confirming receipt of his/her order (hereinafter the “Order Confirmation”). Unavailability of Products: In the event of unavailability of the Product, GOLDBEAUTE undertakes to inform the Customer of this when processing the order via the Order Confirmation referred to in point 3.6 above. GOLDBEAUTE may then either offer the Customer a similar or equivalent product, or offer to cancel the order, or indicate a new delivery time. In the event that the Customer has ordered several Products, only the contract relating to the sale of the unavailable Product is covered by the aforementioned stipulations. Shipping commitment: If the product is available, GOLDBEAUTE makes a firm commitment to ship the Products. 6. Prices and payment Product prices: Product prices are expressed in Euros, and include all taxes (TTC). VAT rate: The applicable VAT rate is the one in effect at the time the order is validated. Tax details: The details of the taxes applicable to the sale of the Product are indicated when viewing the basket. Payment methods: Orders are paid in cash, using one of the following payment methods: By Paybox 3D Secure bank card (Visa, Mastercard, Carte Bleue, American Express); By bank transfer; Through the Customer's Paypal account. Proof of transactions: Unless proven otherwise, the data recorded by GOLDBEAUTE constitute proof of all past transactions carried out between GOLDBEAUTE and the Customer. 8. Shipping methods and costs Choice of carrier: When validating the basket, the carrier is automatically chosen. The options are: Colissimo or GLS for small hairdressing equipment and accessories, GLS, DASHER, HEPPNER DSV, TRANSPORT SELLIER for furniture. Some items will be available for collection. Shipping costs: Shipping is free in mainland France, Belgium, Poland, Luxembourg, Italy, Spain, Austria, and Denmark. For other countries such as Switzerland, customs fees may be required and are the responsibility of the customer. *For any delivery to Corsica or abroad, the Customer must contact our sales department. Tracking number: Once the Product has been shipped, GOLDBEAUTE will inform the Buyer by sending an email, providing them with the delivery tracking number, if applicable. 9. Delivery Mandated Carrier: Delivery is carried out by a carrier mandated by GOLDBEAUTE. Deliveries are made to the ground floor only. Customer Responsibility: The Products are delivered to the address indicated by the Customer in his “Personal Space”. It is the sole responsibility of the Customer to ensure that the information he communicates to GOLDBEAUTE for this purpose are correct and will allow him to receive the Products. In the event of inaccuracy in the delivery address provided by the Customer, the Products will be reshipped at the latter's expense. Delivery of the Products: Delivery occurs by handing over the Products to the Customer against signature of a delivery slip. In the event of the Customer's absence on the day of delivery, a calling card will be left in his mailbox. In order to take possession of the Products, the Customer must contact the carrier whose contact details will appear on the calling card. Delivery times: Delivery times for France vary from 2 to 7 days (depending on the department, excluding weekends and public holidays). Delivery times for Belgium vary from 5 to 9 days (excluding weekends and public holidays). Delivery times for Switzerland vary from 10 to 12 days (excluding weekends and public holidays). Delivery times to Italy and Spain vary from 10 to 13 days (excluding weekends and public holidays). The delivery times mentioned on the Site are only indicative and may be subject to change. Information for our customers in Overseas France Tax regime: As a customer residing in Guadeloupe, Martinique, French Guiana, Mayotte and Reunion, you benefit from prices excluding taxes (HT) for your purchases. Products are invoiced excluding taxes when validating your basket. VAT will be collected by La Poste upon arrival of your package.
