General terms and conditions of sale

The company GOLDBEAUTE, limited liability company, registered with the Trade and Companies Register of Soissons under number 798 693 800, whose registered office is located at 611 rue des moines 02200 Villeneuve saint Germain (hereinafter referred to as " GOLDBEAUTE ").

These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") apply to all sales concluded by GOLDBEAUTE on the site www.goldbeaute.fr (hereinafter the "Site").

The act, for any customer of the Site (hereinafter the "Customer"), of ordering products sold by GOLDBEAUTE (hereinafter the “Products”) on the Site implies full and unreserved acceptance of these General Terms and Conditions of Sale, which prevail over any other specific conditions of the Customer, in particular its general terms and conditions of purchase, unless otherwise agreed in writing by GOLDBEAUTE. . GOLDBEAUTE reserves the right to modify these Terms and Conditions at any time; they will be applicable as soon as they are published online, excluding transactions already in progress.

1. PROFESSIONAL QUALITY

1.1 The site is exclusively reserved for professionals. As such, the Client must provide, when registering on the Site, the company name and their first and last name.

1.2 The Customer undertakes to make purchases on the Site (hereinafter the Purchases) solely for the needs of his professional activity.

2. REGISTRATION ON THE SITE

2.1 All purchases made on the website are subject to the creation of an account by the Customer. The Customer must provide the contact information necessary for the processing of their orders (billing, delivery) by GOLDBEAUTE, notably :

His postal address and his email address

2.2 The Client undertakes to update this information as soon as any change occurs to their contact details.

2.3 Finally, the Customer must choose a username and password (hereinafter the "Credentials") which they will be required to reuse for future purchases on the Site. The Customer agrees to keep their Credentials secret and not to disclose them to any third party. The Customer is solely responsible for access to the Site using their Credentials, unless they can provide proof of fraudulent use that is not attributable to them.

3. CONCLUSION OF THE SALES CONTRACT

3.1 The Products are presented on the Site with a description enabling the Customer to know their essential characteristics and their price.

3.2 Product availability is indicated on its product description page. The product may be "in stock" or "being restocked". GOLDBEAUTE makes every effort to ensure the accuracy of product availability information. However, it cannot be held liable if such information proves to be inaccurate.

3.3 The Customer selects the Product(s) he/she wishes to purchase.

3.4 He confirms his choice of Product(s) by validating his basket and acknowledges and accepts these Terms and Conditions by clicking to validate.

3.5 The Customer then proceeds to pay for their order under the conditions set out in article 4 of the General Terms and Conditions.

3.6 Once the payment has been validated, the Customer receives an email confirming that their order has been received (hereinafter the "Order Confirmation").

3.7 In the event that the Product is unavailable, GOLDBEAUTE undertakes to inform the Customer during the order processing process via the Order Confirmation referred to in point (3.6) above. In this situation, GOLDBEAUTE The company may either offer the Customer a similar or equivalent product, offer to cancel the order, or provide a new delivery date. If the Customer has ordered multiple Products, only the contract for the unavailable Product is subject to the aforementioned provisions.

3.8 If the product is available,GOLDBEAUTE makes a firm commitment to ship the Products .

4. PRICE AND PAYMENT

4.1 Product prices are expressed in Euros and include all taxes.

4.2 The applicable VAT rate is that in force at the time of order validation.

4.3 Details of the taxes applicable to the sale of the Product are shown when viewing the shopping cart.

4.4 Orders are paid in cash, using one of the following payment methods:

by Paybox 3D Secure bank card (Visa, Mastercard, Carte Bleue, American Express) ;

by bank transfer

via the Client's Paypal account.

4.5 Payments are made through an online payment operator, PAYBOX E-TRANSACTION. All payments made on the Site are processed securely using the SSL encryption protocol.

5. ORDER CONFIRMATION

5.1 Once the order and payment have been validated, GOLDBEAUTE sends a confirmation email to the Customer with a summary of their order, including in particular:

The billing address and the delivery address,

The quantities and descriptions of the items ordered,

For each product: the price H.T. & the applicable VAT rate,

The total price H.T. applicable taxes (including VAT)

The total price T.T.C.

5.2 Unless proven otherwise, the data recorded by GOLDBEAUTE constitute proof of all past transactions carried out between GOLDBEAUTE and the Client.

6. SHIPPING METHODS AND COSTS

6.1 At the time of basket validation, the carrier is automatically selected

For small hairdressing equipment and accessories, delivery is made via Colissimo or GLS.

Furniture delivery will be handled by carriers such as GLS, DASHER, HEPPNER DSV, and TRANSPORT SELLIER.

6.2 Delivery is free in Metropolitan France*, Belgium, Poland, Luxembourg, Italy, Spain, Austria and Denmark

For other countries such as Switzerland, customs fees may be required; these remain the responsibility of the customer.

6.5 Once the Product has been shipped, GOLDBEAUTE will inform the Buyer by sending an email, providing them, if applicable, with the delivery tracking number.

7. DELIVERY

7.1 Delivery is carried out by a carrier appointed by GOLDBEAUTE. Deliveries are made to the ground floor only.

7.2 The Products are delivered to the address indicated by the Customer in their "Personal Account". It is therefore the sole responsibility of the Customer to ensure that the information they provide to GOLDBEAUTE The information provided by the customer is correct and will remain so, enabling them to receive the products they purchase on the website. If the delivery address provided by the customer is inaccurate, the products will be reshipped at the customer's expense.

7.3 Delivery is effected by handing over the Products to the Customer against signature of a delivery note. If the Customer is absent on the day of delivery, a delivery notice will be left in their mailbox. To take possession of the Products, the Customer must contact the carrier whose contact details will be provided on the delivery notice.

7.4 Delivery times for France vary from 2 to 7 days (depending on the department, excluding weekends and public holidays).

Delivery times for Belgium vary from 5 to 9 days (excluding weekends and public holidays).

Delivery time to Switzerland varies from 10 to 12 days (excluding weekends and public holidays).

Delivery times to Italy and Spain vary from 10 to 13 days (excluding weekends and public holidays).

The delivery times mentioned on the Site are indicative only and may be subject to change.

If a package is not received within the stated delivery time, an investigation will be conducted with the carrier, which may take several days (e.g., 21 days with the postal service and the carrier). During this period, no refund or reshipment will be possible.

The delay in delivery does not entitle the Customer to any compensation.

Products damaged upon delivery

7.5If a damaged item is received, the customer must refuse the package from the carrier and write a clear note of damage on the delivery slip (e.g., "damaged package", "product broken inside", etc.).

 The customer will then need to inform GOLDBEAUTE.FR within 48 hours with supporting photos, so that the case can be processed as quickly as possible.

 In this case, a new identical package will be shipped immediately, at no additional cost to the customer.

 ⚠️ No refunds will be accepted for items damaged upon delivery, except in cases where the product in question is permanently unavailable.

 Replacement with a new product remains the only solution offered in this type of situation, in accordance with our after-sales service policy.

7.6 Clause – Grouping, appointment scheduling and refusal of delivery

Delivery instructions. When confirming the order, the Customer may indicate instructions in the "Order Message" field. If no specific date is indicated and accepted in writing by GOLDBEAUTE, Delivery takes place during the first time slot offered by the carrier, after grouping the items if the Customer has requested "deliver all at the same time".

No storage service. Nor GOLDBEAUTE Neither its carriers nor its carriers provide any pre-delivery storage or safekeeping services. The Customer is responsible for arranging any desired storage after receipt.

Impossibility attributable to the Client. Any impossibility of delivery linked in particular to: absence at the time of delivery, refusal of delivery except in the case of damage noted, incorrect/incomplete address, impossibility of access, request for postponement not agreed upon, demand for a date not indicated in the order or erroneous mention "by mistake".

Return/Redelivery Fees. If delivery is impossible due to the Customer's fault, the shipment will automatically be returned to the warehouse. The Customer will be fully responsible for the return shipping costs, any storage fees charged by the carrier, and the redelivery fees, at the actual cost plus, where applicable, an administrative fee.

Preferred dates. Any date provided by the Client as an indication only has no contractual value until it has been confirmed in writing by GOLDBEAUTE or by the carrier. Once the goods have been taken into the carrier's care, the date can no longer be guaranteed or changed without additional charges.

Obligation to cooperate. The Client agrees to remain contactable, to answer calls/texts from the carrier, and to accept the first delivery attempt. Otherwise, paragraph 4 applies.

7.7 Clause – Products intended for export (delivery via freight forwarder)

For any order destined for abroad and transiting through a freight forwarder designated by the Client, the responsibility of GOLDBEAUTE ends when the goods are handed over to the freight forwarder.

The insurance taken out by GOLDBEAUTE covers the goods only up to the delivery point indicated on the transport document, i.e. until receipt by the freight forwarder.

From the date of this discount:

The freight forwarder becomes solely responsible for the control, storage and reshipment of the goods to their final destination.

It is his responsibility to inspect the goods upon receipt, to immediately report any anomaly (damaged package, missing product, non-compliant item, etc.), and to refuse damaged products in accordance with the general conditions of transport.

No further claims will be considered by GOLDBEAUTE if the check has not been carried out at this stage or if no specific reservation has been issued by the freight forwarder upon receipt.

In the event of a dispute, the end customer must contact the freight forwarder directly for any declaration or compensation procedure.

If in doubt, GOLDBEAUTE can assist the Client in preparing the claim file with the carrier, without however assuming responsibility beyond the point of transfer.

8. RETENTION OF TITLE

8.1 GOLDBEAUTE retains ownership of the Products whose transfer is conditional upon full payment of their price. GOLDBEAUTE reserves the right to claim the return of the Products in the event of non-payment by the Customer of the full price.

8.2 On the other hand, the risks are transferred to the Client upon receipt of the Products by the latter.

8.3 The Customer is prohibited from using the Products subject to this retention of title clause as collateral. The Customer undertakes to notify all its creditors of this retention of title clause.

9. RIGHT OF WITHDRAWAL

9.1 Notwithstanding the Client's professional status, GOLDBEAUTE grants him the benefit of a right of withdrawal. Thus, for any Purchase made on the Site, the Customer has a period of fourteen (14) days from receipt of the ordered Product(s) to exercise, with GOLDBEAUTE ,his right of withdrawal, without having to provide justification or pay a penalty (hereinafter the "Right of Withdrawal").

9.2 Notwithstanding the foregoing, the Right of Withdrawal does not apply to:

Custom-made or made-to-measure products ;

Products that have been installed ;

Products that have been opened and are not returnable for hygiene or health protection reasons (especially products intended for contact) ;

9.3 If the Right of Withdrawal is exercised within the aforementioned period, the price of the Product(s) subject to the right of return will be refunded, with the return costs remaining the responsibility of the Customer.

9.4 Products subject to the right of withdrawal must be returned within fourteen (14) days of exercising this right, in their original condition (except for normal wear and tear) and complete (packaging, accessories, instructions, etc.) in the same packaging used for shipping (cardboard box, bubble wrap, polystyrene, etc.).

9.5 GOLDBEAUTE The company will then proceed with the refund of the Products covered by the Right of Withdrawal by crediting the bank card or PayPal account used for the order, as soon as possible and at the latest within fourteen (14) days of the date on which the right was exercised. The refund of the Products concerned will only be processed after their receipt and verification by the returns department. GOLDBEAUTE.

9.6 Subject to Articles 10 & 11 below, after the period of fourteen (14) days, the goods will not be returned or exchanged.

9.7 For any order cancelled during delivery, 10% of the total amount including VAT will be deducted from your refund. This fee covers bank charges, order preparation, and shipping costs.

9.8 Procedures for exercising the right of withdrawal

Notification of exercising the right of withdrawal does not constitute actual return of the product.

The Customer is required to actually return the Products (shipment or drop-off validated by GOLD BEAUTE) within the applicable legal time limit, and to provide, where applicable, the elements necessary for the validation of the return (photos, original packaging, product conformity).

If the Products are not effectively returned within the time limits and conditions stipulated above, the right of withdrawal will be considered not exercised, and no refund can be claimed.

 

If the item is not returned within the specified time and conditions, the right of withdrawal will be considered not exercised, and no refund will be issued.

10. GUARANTEES

The warranty on all our products is a 1-year manufacturer's warranty, unless otherwise stated in the product description.

It is limited to the replacement of a defective part or item. Regarding hairdressing chairs, the barber chair ,For hydraulic tables and stools, only the pump is guaranteed. Regarding aesthetic tables, massage tables, spa chairs, pedicure chairs, and all other furniture, the upholstery is excluded from the guarantee.

During the immobilization of the equipment, the warranty does not provide for any replacement equipment to replace defective equipment, and the customer will not be entitled to any compensation.

The total or partial impossibility of using the products, in particular due to hardware incompatibility, shall not give rise to any compensation or reimbursement or to any claim of liability. GOLDBEAUTE

The repair does not change the original warranty date.

Warranty exclusion

The following are excluded from the warranty:

- Replacement of consumables, wear and tear (plastic parts, plastic covers, welds, seals, shower heads, remote controls, etc.)

-Corrosion, oxidation, poor connection, or external power supply problems. For example, if a connection is made to a faulty socket, the warranty will not apply.

- unusual or incompatible use of the products

- accessory failures (power cord), malfunctions and their

consequences due to an installer/repairer not authorized by the seller,

- defects and their consequences resulting from misuse

-Damage to the Product resulting from normal wear and tear, taking into account its nature, function, and composition

All defects in the Product that may result from improper installation, storage, handling, or assembly (failure to follow assembly instructions), lack of maintenance, misuse, or use not in accordance with technical or usage specifications (failure to follow maintenance and care instructions), modifications or repairs carried out by the Customer or a third party, damage caused by external objects, external events such as accidents, impacts, fires, acts of vandalism, water damage, natural or artificial light (in the event of discoloration of fabrics and coverings), natural disasters, or inclement weather

The following are excluded from the Guarantee: damage caused directly or indirectly by:

damage originating from a cause external to the product, such as, and without this list, which is only an illustration, being exhaustive: shock, fall, misuse, prolonged use of electrical equipment (overheating), handling error, burns, discoloration in light, humidity, excessive heat, cuts, scratches, any impregnation by a liquid.

-Damage resulting from failure to follow maintenance instructions (Stain caused by the use of cleaning products or chemicals.)

-Damage resulting from failure to comply with installation or assembly that does not conform to the manufacturer's recommendations

- Damage to furniture and its contents, or any other furnishings, resulting from the breakage of the wall support

For furniture, defects in appearance related to a difference in shade, and/or the structure of the wood, differences in shade related to restocking, variations in shade due to the influence of light over time.

-The damage does not affect the proper functioning of the device, in particular aesthetic damage: Chair covers, beauty tables, tattoo tables, spa pedicure equipment..., covers and cushions including buttons, snaps, zippers, seams, paint and coverings...

scratches, scrapes, impact marks on the woodwork or enamel, smoker's accident, and the following parts: lamps, indicator lights, water inlet pipe and seal, drain pipe, mirror, exterior windows, cover, any accessory in general unless they are the direct consequence of damage of guaranteed internal origin.

-Normal wear and tear that does not affect the use or safety of the product on a daily basis.

-Damages involving the liability of a third party or resulting from intentional or fraudulent misconduct.

-Remote controls and memory cards for electrical equipment, etc...

-The cost of cleaning the products if it proves necessary to carry out the repair.

-Elements or accessories that require regular replacement (batteries, lamps, bulbs, filters, etc.).

-Replacing light bulbs, connecting cables between devices, etc.

-Damage occurring during the transport or relocation of the product carried out by the customer or one of their representatives under their responsibility.

-Related costs and/or damage caused by poor product power quality: faulty electrical voltage, voltage error, filter cleaning...

- Warranty exclusions related to the nature of the damage (indirect damages):

The warranty only covers the right to repair or replace the product covered by the warranty. Therefore, indirect damages resulting from a defect or deterioration in quality are not covered by the warranty.

Return shipping costs are the sole responsibility of the buyer.

The guarantee is not valid if payment has not been made.

Please keep the original boxes during the warranty period, as without the packaging and inner protection (polystyrene), no item will be collected.

Products returned incomplete, soiled, damaged or without original packaging and protection (polystyrene) and labels will not be accepted.

Retention clause

The delivered goods remain the property of the company GOLDBEAUTE Payment pending

Full price in principle and accessories.

11. DISPUTES - CONTESTATIONS

Reservations with the carrier

11.1 In the event of transport damage or missing goods, the Customer shall be required (i) to make all specific and substantiated reservations (i) upon receipt on the waybill in the presence of the carrier or (ii) within three (3) days of delivery by registered letter with acknowledgment of receipt addressed to the carrier, in accordance with Articles L133-3 et seq. of the French Commercial Code. The Customer must also send a copy of these reservations to GOLDBEAUTE. If no reservations are made within the allotted time, the goods will be deemed to have been received in good condition.

Damaged or non-compliant product

11.2 The Customer has the option to report any complaint concerning the Products ordered, within thirty (3) days of receiving the order, in their account, according to the following criteria:

Non-compliant product: the product received does not correspond to the product ordered (and provide sufficient evidence of the damage affecting the product (including photographs).

Damaged product: The received product is broken or damaged, and sufficient proof of the damage to the product is provided (including photographs).

11.3 If the Client's claim is justified, the dispute declared by the Client will give rise, as appropriate, to

11.3.1 If the Product is not compliant, the Customer must return the Product in question in the condition in which it was received, in its original packaging, with all accompanying elements (accessories, packaging, instructions). 11.3.2 If the Product is broken or damaged: the Customer must, at the request of GOLDBEAUTE :

Either return the Product in question in the condition in which it was received, in its original packaging, with all accompanying elements (accessories, packaging, instructions); GOLDBEAUTE and the Customer will jointly choose the appropriate mode of transport for this return, depending on the volume and weight of the Product.

11.4 If the Customer returns the Product in question, the refund will only be issued after its receipt by GOLDBEAUTE.

Product not received

11.5 The Customer has the option to report, within twenty-one (21) working days from the Order Confirmation, the non-receipt of the Product.

11.6 If it is proven that the non-receipt by the Customer is not due to a delay, the dispute declared by the Customer will result in the reshipment of the Product.

11.7 If it is proven that the non-receipt is due to a delay not attributable to GOLDBEAUTE, , GOLDBEAUTE will communicate a new delivery date to the Client.

11.8 If it is proven that the non-receipt is due to a delay attributable to GOLDBEAUTE, The customer will have the choice between:

The order cancellation will result in a refund.

Determining a new delivery date.

12. RESPONSIBILITY

12.1 GOLDBEAUTE is only responsible for the content of the pages it publishes. Photographs illustrating the Products are provided for illustrative purposes only.

12.2 GOLDBEAUTEShall not be liable for any indirect, consequential, or incidental damages arising from this agreement, including but not limited to loss of business, loss of profits, loss of opportunity, damages, or expenses that may result from the purchase of the Products. The total or partial inability to use the Products shall not give rise to any compensation, reimbursement, or liability on the part of [Company Name]. GOLDBEAUTE. The responsibility of GOLDBEAUTE is limited, for all causes combined, to a sum which is capped at the amounts of sums collected for the supply of the Products.

13. INTELLECTUAL PROPERTY

13.1 All texts, comments, works, illustrations, and images reproduced or displayed on the Site are strictly protected by copyright and intellectual property rights for the full duration of such protection and worldwide. Any reproduction or representation, in whole or in part, of the Site or any of its elements is strictly prohibited.

13.2 Any copying or reproduction by any means whatsoever would constitute an infringement punishable under the penalties provided for by the Intellectual Property Code.

13.3 The trademarks appearing on the Site are the property of their owner and any unauthorized use by the latter would constitute an act of infringement.

14. PERSONAL DATA

14.1 The Client expressly agrees that personal data concerning him or her may be processed electronically by GOLDBEAUTE under the conditions defined below:

GOLDBEAUTE collects and sorts, using computerized systems, the Client's individual data in order to improve the relationship GOLDBEAUTE-Client based on market research and to notify the Client of promotional operations ;

Access to Client data is limited to persons authorized to perform data processing, security and IT maintenance operations ;

The Client has the right to access and rectify computerized data concerning him/her ;

The Client may at any time revoke the authorization granted above and object, for legitimate reasons, to the processing of their personal data by GOLDBEAUTE.

15. NON-WAIVER

15.1 The failure of either Party to enforce any right or provision of these Terms and Conditions shall not be construed as a waiver of such right or provision.

16. PARTIAL NULLITY

16.1 If one or more provisions of these Terms and Conditions are held to be invalid or declared as such pursuant to a law, regulation or final decision of a competent court, the other provisions shall remain in full force and effect.

17. APPLICABLE LAW

17.1 These General Terms and Conditions are governed by French law, excluding the provisions of the Convention. In the event of a dispute between GOLDBEAUTE and the Client, the competent jurisdictions will be those of the district where the registered office is located. GOLDBEAUTE.
